What is the night differential pay?

The rate of night-shift differential pay in the Philippines should not exceed 20% of the hourly basic rate of the employee. You can also compute it using the following formula:

Ordinary night differential = (Hourly rate × 10% × 8 hours)

Say you have a day shift employee who works for ₱150 per hour. If you were to create a night shift counterpart for the role, you’d be paying the employee ₱165 per hour instead. So, if they work the full 8-hour night shift, you pay them ₱1,320 for the day.

But if the shift starts at 12 m.n., only 6 hours are covered by the night differential pay, and the last two hours will be under regular pay. Hence, your employee will earn ₱1,290 for the day.

What are the rights of night shift workers?

RA No. 11701 mandates the following rights for night shift workers:

Compensation for work beyond regular hours

If a night shift worker works beyond their regular shift, you should compensate for the excess hours according to the rules and regulations on overtime services and pay.

Protection from discrimination

You should not subject night shift workers to any form of discrimination based on their work schedule. They have the same rights and protections as daytime workers.

Formulation of internal rules

As an employer, you must formulate and adopt internal rules and procedures consistent with the provisions of RA 11701. One rule is the determination of the night shift differential rate, which should not exceed 20% of the hourly basic rate of the employee.

RA No. 10151, which focuses on focuses on the employment of night workers, also requires employers to follow the rules below:

Health assessment

Night workers have the right to undergo health assessments without charge before starting a night work assignment, at regular intervals during their assignment, and if they experience health problems associated with night work.


You should transfer night employees who are unfit for the night shift to a similar job in which they are suitable. If the transfer is not possible, you should grant these workers the same benefits as others who can’t work due to health reasons.

Mandatory facilities

You should provide suitable first-aid facilities for workers performing night work. Additionally, you must implement safe and healthful working conditions and offer adequate facilities such as sleeping or resting quarters in the establishment and transportation from the work premises to the nearest point of their residence.

Penalties for violations

If you fail to comply with the law, you may face fines ranging from ₱30,000.00 to ₱50,000.00, imprisonment for not less than six months, or both, at the discretion of the court.
